Liquor Licence Laws of NSW

In July 2008, the New South Wales Government introduced new liquor licence laws. It is the first time in over 25 years that any significant change has been made to the Liquor Act of NSW. With these changes come new types of Liquor Licences. There are now six (6) types of liquor licences in NSW.  ArtisanOz Consulting can assist you in all the different types of liquor licences, such as;

 

Hotel Licence

There are two (2) types of Hotel Liquor Licences.
The first being a traditional Hotel Licence which allows for the sale of liquor for the consumption on the premises and takeaway sales. It also allows (subject to government approval) for the provision of gaming related activities such as: TAB, Keno and poker machines.
The second being a General Bar Hotel Licence which allows only for the consumption of liquor on the premises. NO gaming related activities and NO takeaway sales of liquor. 

 

Club Licence

This type of Liquor Licence is for Registered Clubs, as defined under the Registered Clubs Act 1976. This licence allows for the sale of liquor for the consumption on the premises and takeaway sales, for members and their guests.

 

Packaged Liquor Licence

There are two (2) types of Packaged Liquor Licences.
The first being a traditional ‘bottleshop’ where a customer actually walks into a physical premises. The liquor is for takeaway sales.
The second being for ‘remote sales’. There is NO physical premises for a customer to walk into. All sales of liquor are to be made via remote means, such as over the internet or phone, via fax or mail order. The liquor is then delivered via courier or similar.

 

On-Premises Licence

A number of different types of liquor licences have now been merged into the On-Premises Licence, such as;

 

On-Premises Licence (Restaurant)
Allows for the sale of liquor for the consumption on the premises with the consumption of food.

On-Premises Licence (Restaurant) with a Primary Service Authorisation
This type of licence allows for the sale of liquor for the consumption on the premises with or without food.

On-Premises Licence (Public Entertainment Venue)
Sale of liquor for consumption on the premises with entertainment.

On-Premises Licence (Motel, Vessel, Theatre, Cinema)
Sale of liquor for On-Premises consumption with some other good or service.

 

Producer / Wholesaler Licence

This licence type encompasses the old vigneron, brewer and wholesaler liquor licences under the one licence type. Takeaway sales of liquor are allowed at any time to other liquor licensees. If a small scale brewery or distillery is located outside of Sydney, Newcastle or Wollongong they can conduct public tastings and offer takeaway sales to the public.
Wine producers can offer cellar door sales, takeaway sales direct to the public at a wine show, producers market or fair. Wine producers can also provide the sale of liquor for on premises consumption in a restaurant, motel / accommodation or at a function, as part of a Drink On-Premises Authorisation.

 

Limited Licence

Replaces the old temporary or permanent function licence. The Limited Licence is ONLY for Not For Profit organisations. The licence allows for the sale of liquor for consumption on the premises.

Cost of liquor licence applications varies depending on the type of premises and special conditions involved.

 

Liquor Licence Transfers

Cost of a liquor licence transfer is significantly less as it does not relate to the premises, only the proposed licensee.

 

(RSA) Responsible Service of Alcohol Training Courses  

ArtisanOz Consulting can provide the SITHFAB009A - Provide Responsible Service of Alcohol (RSA) Training Course to NSW Liquor Licence clients. The cost of providing RSA training to staff will be dependant on the amount of people that need to be trained. In NSW, RSA training is mandatory for all staff involved in the sale and supply of alcohol, including Security Officers. We can organise to do RSA Courses anywhere in NSW including:

 

Sydney, Parramatta, Newcastle, Wollongong, Central Coast

Miscellaneous information

Liquor Licensing in NSW is extremely complex and diverse.  There are liquor licence applications for literally everything, some of these applications may include, however not limited to the following:  Change of Liquor Licence Name, Change of Boundaries, Change of Conditions, Change of Financial Interest, Approved Manager's application, Extended trading hours, Drink on Premises Authorisation.
